They've probably already started production on the hardware and a firmware update could simply be the most cost-effective way to make changes. Plus whatever OS stuff they may be cramming in at the last moment.
A firmware update would also be the fastest way to re-implement it down the road, after they have your money.

After the backlash I don't think there's a snowballs chance in hell they implement psychical DRM. It's a dying medium anyway. That's why I think MS was stupid for doing it in the first place.
My only contribution to this thread is to announce that I am extremely excited about the life-changing news that Age of Empires is being developed for IOS.

Too bad. I keep wanting to beat Borderlands 2, but after the first game being just crazy long for a pretty repetitive (but totally awesome and entertaining) shooter, I got bored of the sequel about 12 hours or so in. I had a few evenings of multiplayer with 3 of my coworkers, and it was deliriously entertaining. Then again, I have loved co-op focused games since Smash TV on SNES.
That's the only way I could get through the sequel. Unfortunately I'm on a PC and Steam, and my only Steam friends are fellow Counter-Strike losers who won't let go.

i dont think this is completely true. i attempted to do this over my lunch hour and while it was "free" i had to pay tax on it so i declined the offer.
