Not really similar, but still a family member vs family member in court because of insurance.
My parents were involved in a wreck in July. They were at a complete stop behind two other vehicles. Another vehicle slams into them (never applied brakes) and rear ends them, slamming their car into the car in front of them.
The only one ticketed, somehow, was my parents. Worst police report the attorney had ever seen (an attorney that saw the stupidity and didn't even charge my parents).
Both were taken to the ER by ambulance with neck and back injuries. Both x-ray'd, one having to go to another hospital the next day because of pain. That parent eventually having back surgery and lots of rehab.
But, because of the police report and other stuff, one parent will likely have to sue the other one. I don't even care for specifics really, but I can see how this can happen.
Obviously a different situation.

This is in regards to the completely asinine police report.
When I was in high school my parents were in a boating accident where the other boat hit them from behind. Our boat was fine other than needing a little fiberglass work on the back right corner. Their boat was sinking when they got it back to the ramp with tons of damage to the middle left of their boat. The idiot who wrote the report wrote it out as if it were my dad's fault based on witness statements. Of course those witnesses were the friends with the people who hit our boat. My parents swear that when the accident happened there were six people on the other boat but only four when they got to the dock with the other two being the 'third party witnesses' that the report based the 'facts' on.
Any person with any sense could immediately tell that the report was completely wrong and my dad was not at fault. They claimed that my dad came up from behind them at 30mph and wasn't on plane so he couldn't see them and then he ran into their boat. First of all, at 30mph that boat is DEFINITELY planed out and visibility is just fine but without violating the laws of physics or backing up, there is absolutely no way to run the right rear of the boat into the middle left of the other while passing them from behind.
Our insurance company paid for the repairs to our boat with no problem but refused to pay the claims from the other boat which included all kinds of neck and back and other injuries. The other people sued multiple times. Every time the insurance company's lawyer told my parents to not even worry about it and the case was thrown out every single time. They literally refiled five different times and it got thrown out every single time.

Sounds pretty similar. The cop in the case of my parents' wreck said they had 3 witness statements from people not involved in the wreck. Nobody that was outside would have even looked over until they heard anything, and by the time they're looking over it's already a pile up. The car hitting my parents' car never hit the brakes, so no screeching of tires or anything else. It may be true-Family sues family all the time (really it is the insurance co), as the attorney points out. (As an injury attorney he should know all about this stuff). It also may be true she had real injury since she had surgery. However, this attorney has no idea whether she was making this incident up for cause of her injury and does not not address why the jury would rule quickly against it.

Does she deserve this level of demonization? Probably not.
Though, she appears to be an educated person and she did sign off on this

If both parties are fine with it, and it's the only way to have insurance cover the injuries, I'm not sure what difference the wording used in the suit makes. What other option is there legally.
My understanding is her insurance won't cover it because they believe someone else to be at fault. So they forced the suit. Now the jury has rejected that so it will fall back to her insurance to cover.
